ABC News recently published an article on New York's $464 million money judgment against Donald Trump and co-judgment debtors, and I was quoted for insight into how that judgment might be enforced:
“According to judgment enforcement attorney Peter Agulnick, [the NYS Attorney General] could attempt to get a fuller picture of the former president's finances…'You could subpoena the judgment debtor and require him to give his tax returns and all sorts of documents concerning his financial condition,'" I explained. — ABC News, March 21, 2024
As a New York attorney focused on judgment enforcement, I regularly use the same legal tools now being discussed in the Trump matter. While the size of this judgment is extraordinary, the strategies being considered—such as freezing bank accounts, appointing receivers, and intercepting sources of income—are the same tools available to any judgment creditor's lawyer trying to collect on a judgment.
Judgment Enforcement Is What We Do
I assist clients ranging from businesses and law firms to individuals and out-of-state creditors. Whether the judgment is $50,000 or $50 million, I work to ensure it gets paid. Enforcement steps often include:
- Restraining notices to freeze funds
- Garnishment and turnover orders
- Receiverships to manage or sell assets
- Subpoenas to uncover hidden or transferred assets
- Fraudulent-transfer actions
